Dear Lt. Pond:

Thank you for your response to our formal complaint against APD actions during the August topless protest rally in downtown Asheville.  We note your position that there was no performance failures by your officers.

It would be our continued position that Asheville City and Police administrators did condone the violation of NC General Statutes 14-190.131&6, 14-190-15(b)&(c)3, 14-190.15, and 14-190-9(b) governing sexually explicit behavior, child sexual abuse, public nudity, and exhibiting harmful performances to minors during the August 21^st rally.

For purposes of clarification, we did want to make sure, per your notice that APD officers performed their duties, that going forward the following behaviors will not trigger enforcement in downtown Asheville?

1)      Stripteases, dancing, sexually expressive behavior, and other forms of performance on the city fountain.

2)      Participants squeezing exposed breasts in a sexually suggestive manner in public view.

3)      Underage topless teens actively participating in organized protests.

4)      Males fondling exposed female breasts in public view.

5)      Sexual performance in the presence of minors.

It would be our further observation that political paralysis and principle pretense is more damaging to officer morale than factual criticism of city and police administrations.   Per the pictures above, your investigative outcome must be at least a little bit embarrassing.

GoTopless.org Celebrates North Carolina as the South’s Only Topless State and Asheville as the South’s only Official Topless Tested City!

Subject:           North Carolina and Asheville receive dubious GoTopless.Org honor

To:                   Concerned WNC citizens

ASHEVILLE – According to the GoTopless.org folks, North Carolina is one of thirteen states that support topless frivolity and the only state in the south to do so.   On their website, Asheville is listed as an “official topless tested city.”

Remember, it’s not about breasts or breast feeding.  The real fight, and the one the media, public officials, and other apologists work hard to disguise, is about—

1) Stripteases, dancing, sexually expressive behavior, and other forms of performance on the city fountain.

2) Participants squeezing their exposed breasts in a sexually suggestive manner in public view.

3) Underage topless teens actively participating in organized protests.

4) Males fondling exposed female breasts in public view.

5) Sexual performance in the presence of minors.

Our city and police administrations, the State Attorney General’s office, and Buncombe county D.S.S. say nothing wrong happened last August.  Pictures at the event say something different.  Per the official position, the above behaviors must be OK.   If the GoTopless.org folks are really serious about their mission, we would encourage them to repeat these activities on a regular basis here in Asheville.  They’ve been given an official pass on their liberty to further downgrade our community, culture, and state.  Perhaps they can share the use of public property in front of City Hall by the Occupy Asheville folks.
